Wills

Reasons for making a will

No one wants to think about death or what will happen after they have gone but making a will is important for people of all ages.

A professionally prepared will, ensures that your loved ones are protected and that your assets are divided/shared, as per your wishes, upon the event of your death.

Whether as a couple or as an individual, if you don’t have a will, here’s what you need to know:

What to include in your will

A will is your express wishes of what you wish to happen to your assets should anything happen to you. Your property, possessions, children… who will inherit your belongings and who will look after your children? What are the instructions for your funeral? A will is how you communicate your wishes upon the event of your death and offers assurance that your requests will be met.

A Professional, Legally Binding Document

Unlike just telling people what you want to happen, or writing it down on informal scraps of paper, a professionally prepared and witnessed will is a legally binding document that offers you peace of mind. Of course, you can write a will on a piece of paper but it will need to be witnessed by two people in England, neither of who can benefit from your will although they can act as executors.

Choosing an Executor

An executor is a nominated person that will act on your behalf to make sure that your wishes are carried out. It is important, when choosing this person, that you make the choice carefully. Choose someone that is neutral, that will act in your best wishes and that has nothing to gain (awful as that sounds). Nominating someone who can act with less emotion, and that can deal with any issues that may occur, the best course of action.

Protecting Your Children

When it comes to children, if you don’t specify your wishes of who will care for your children, it could be left in the hands of the family court. If you have children under the age of 18, it is extremely important that you stress your wishes for them. We don’t want to think about what will happen to young children if anything were to happen for us, but they must be your priority. Even if you have little assets to divide, a legally binding will protects your children from ending up somewhere other than where you want them to be. You will need to discuss your wishes first with the relevant parties, and gain prior agreement from the guardians that you choose whether that be your partner, your siblings, friends or parents.

Respecting Your Funeral Wishes

Wills are important documents that ensure an individuals wishes for their final send-off are met.

Do you want to be buried or cremated, what sort of ceremony do you want and do you have any other specifications? You can plan your funeral down to the very last detail and include this with your will.

Dividing Your Assets

After any debts have been settled, the funeral has been paid for and bills have been satisfied, your assets will then be divided/assigned to the person/organisation of your choice. You may have children that you want to put the money in trust for, you may want to divide your assets up between loved ones. Those without dependants often leave their estate to charities or other organisations. Bes sure to consider any property, belongings, savings, investments, insurance policies etc.

Respecting Your Funeral Wishes

A will also ensures that the wishes for your final send-off are met. Do you want to be buried or cremated, what sort of ceremony do you want and do you have any other specifications? You can plan your funeral down to the very last detail and include this with your will.
